Affairs (Jamdatun), Ferry Wibisono, SH. MH. CN., accompanied by the Secretary of Jamdatun along with the Directors and Officials of Eselon II as well as the Head of The Center for Legal Information (Kapuspenkum), Hari Setiyono, SH. MH. participated in the Signing Of The Cooperation Agreement between Jamdatun Kejaksaan Agung RI with PT Taspen (Persero) that was held in PT.Taspen (Persero) Hall on Jl. Letnan Jenderal Suprapto No. 45, Cempaka Putih, Central Jakarta.

           The Signing Of The Cooperation Agreement was also attended by the President Director of PT. Taspen (Persero), A.N.S. Kosasih, accompanied by the President Commissioner General Commissioner (Police), Suardi Halius, and the Directors of PT. Taspen (Persero). In his speech, the President Director of PT.Taspen (Persero) expressed his appreciation for the performance of Kejaksaan Agung RI. Especially Jamdatun in assisting various State-Owned Enterprises (BUMN) under the Minister Of State-Owned Enterprises in handling legal issues in the Civil and State Administration sector based on personal experience. Before becoming the President Director of PT. Taspen (Persero), A.N.S. Kosasih was accompanied by the State Attorney (Jaksa Pengacara Negara) in resolving legal issues at the International Arbitration Trial in Singapore. Therefore, PT. Taspen (Persero) enthusiastically welcomed today's Signing Of The Cooperation Agreement.

            In addition, the President Director of PT. Taspen (Persero) hopes that this agreement can improve the performance of PT. Taspen (Persero), especially in the pension fund investment of the State Civil Apparatus (ASN) which is the main source of finance for PT. Taspen (Persero);

            In his speech, Deputy Attorney General for Civil and Administrative Affairs (Jamdatun), Ferry Wibisono, SH. MH. CN. said that PT. Taspen (Persero) as a State-Owned Enterprises (BUMN) must act carefully in the policy making and always guided by the Good Corporate Governance (GCG), because the source of finance of PT. Taspen (Persero) is State's Finance and different from private companies and possibly have criminal implications. Do not let the effort to improve the company become an opportunity for criminal acts that has been going on caused by the lack of juridical consideration in taking policies that are actually only to improve the performance and income of the company.

1. Taspen (Persero) in implementing the ultra vires actions against the decisions and steps taken outside of authority must be done carefully and to pay attention to juridical factors, because these actions often create conflicts of interest and are not in corresponding with corporate steps and the consequences of these actions can lead to criminal acts;

            No more professional State-Owned Enterprises (BUMN) managers caught in criminal cases of corruption because business policies do not pay attention to both domestic and International juridical considerations, Good Corporate Governance (GCG) and the effects of criminal law;

            The Cooperation Agreement between the Deputy Attorney General for Civil and Administrative Affairs (Jamdatun) Kejaksaan Agung RI with PT. Taspen (Persero) essentially is about:

1. Providing Legal Assistance by the District Attorney (JPN) in civil and state administration cases on behalf of the FIRST PARTY based on a Special Power of Attorney, either as a plaintiff or as a defendant in litigation or non-litigation, including doing warnings or subpoenas of the FIRST PARTY;
2. Providing Legal Considerations by the Attorney General's Office (JPN) by providing Legal Opinion / LO and/or Legal Assistance / LA in civil and administrative fields as requested by the FIRST PARTY;
3. Other Legal Actions, which is the provision of legal services by the State Attorney Lawyer (JPN) outside of law enforcement, legal reporting and legal considerations in order to save and restore State's finances/assets, as we as enforcing the Government authority to act as a negotiator/mediator or facilitator in disputes between State Institutions, Government Agencies;
4. Returning/recovering FIRST PARTY's assets over the control of third party (especially individuals and private sectors);
5. Collections of arrears from source of income of the FIRST PARTY to individuals and companies;
6. Recommendations to handle the follow up of responsible parties for transferring FIRST PARTY's assets to third party's control;
7. Prevention system recommendations on the transfer of the FIRST PARTY's assets to third party's control
8. Improve the technical competence of human resources.

            As the State Attorney, Jamdatun Kejaksaan Agung RI will act professionally and are not inferior to private lawyers, so that the existence of the State Administration along with their duties, functions and authority can be utilized by PT. Taspen (Persero) in dealing with legal issues in the civil and state administration sector.

            It is also necessary to convey that the State Civil Apparatus and State Administration of Kejaksaan Agung RI are ready to cooperate with Quality, Integrity, and Free of Charge in providing public services including Ministries, Institutions, BUMN and BUMD.
